N.Y. Appeals Court Finds No Coverage for Needed Structural Repairs under "Ordinance or Law" Endorsement
An appellate court in New York, affirming a trial court's decision, has ruled that an "Ordinance or Law" endorsement did not cover structural repairs or modifications needed to bring an insured building into compliance with applicable building codes where the need for the repairs or modifications had been fortuitously discovered in the course of performing remediation of covered property damage. Read More

Mississippi Supreme: Insurer That Filed DJ Action in Federal Court Impliedly Consented to State Court's Jurisdiction Over Coverage Dispute
The Mississippi Supreme Court, affirming a lower court's decision, has ruled that an insurance company that filed a declaratory judgment action in a federal district court in Mississippi impliedly consented to the jurisdiction of Mississippi state courts over the coverage dispute and, therefore, waived its defense of lack of jurisdiction in coverage-related claims lodged against it in a Mississippi state court. Read More

South Carolina Supreme Court Upholds Validity of Insurance Sold Over the Internet
The South Carolina Supreme Court has ruled that a sale of automobile insurance over the internet involved a "meaningful offer" of underinsured motorist coverage as required by South Carolina law and, therefore, that the insured's rejection of optional coverage was enforceable. Read More
