N.J. District Court Refuses to Reopen Superstorm Sandy Case Dismissed After "Months of Inaction"
The U.S. District Court for the District of New Jersey has refused to reopen a Superstorm Sandy coverage case that it had previously dismissed after what it had characterized as "months of inaction," rejecting the plaintiff's argument that his former counsel had been negligent in prosecuting his case.  Read More

West Virginia Supreme Court Overturns Order Requiring Insurer to Disclose Its Insureds' Names and Contact Information in Bad Faith Settlement Case
The West Virginia Supreme Court has ruled that a trial court had erred when it ordered an insurer defending unfair claim settlement allegations arising in connection with a claim for uninsured motorist ("UM") coverage to disclose the names, addresses, and telephone numbers of its other UM insureds.  Read More

N.Y. Appeals Court in Superstorm Sandy Case Rules that Policy's Deductible was $2.5 Million, Not $250,000
An appellate court in New York, reversing a trial court's decision, has ruled that the applicable deductible in a commercial property insurance policy was $2,494,020 and that the claim submitted by the insured for damage caused by Superstorm Sandy did not meet the deductible.  Read More

North Dakota Supreme Court Affirms Dismissal of Insured's Negligence Claim Against Agency, Finding No Breach of Duty or "Special Relationship"
The North Dakota Supreme Court has ruled that an insured's negligence claim against an insurance agency had been properly dismissed, where the agency had breached no duty to the insured and had no "special relationship" with the insured.  Read More
