The U.S. Court of Appeals for the Second Circuit has vacated a decision by the U.S. District Court for the Southern District of New York and suggested that the insurer that had issued a maritime insurance policy was not responsible for investigation and defense costs incurred after its $5 million indemnity limit had been reached. Read More

Grumman's Late and Missing Notices Doomed Its Quest for Coverage of Decades-Old Clean-Up Claims, Second Circuit Affirms
The U.S. Court of Appeals for the Second Circuit, affirming a decision by the U.S. District Court for the Southern District of New York, has ruled that Grumman was not entitled to insurance coverage of decades-old clean-up claims where it failed to show that it had provided timely notice to its insurers, and where the notice it did provide was untimely.  Read More
